This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("you" or "End User") and Bridge Comm., Via Adda 15, Ardea (RM) โ 00040, Italy ("Licensor", "we", or "us") for the use of BookReader for Mac (the "Application"), including any updates, documentation, and related materials provided by us.
By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree, do not download, install, or use the Application.
This Agreement is concluded between you and Bridge Comm. only, and not with Apple Inc. ("Apple"). Bridge Comm., not Apple, is solely responsible for the Application and its content.
If you downloaded the Application from the Mac App Store, you acknowledge and agree that:
Subject to the terms of this Agreement and payment of any applicable subscription fees, Bridge Comm. grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal or internal business purposes on Apple-branded devices that you own or control, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.
This license does not allow you to use the Application on any device that you do not own or control.
The Application is free to download and use in a limited trial mode. Full access to all features requires an active subscription ("Subscription").
If you subscribe through our website or the direct download version of the Application, your purchase is processed by Paddle.com Market Limited, which acts as the Merchant of Record. Your payment is subject to Paddle's Terms of Use. Refund requests for Paddle purchases should be directed to support@macbookreader.it.
If you subscribe through the Mac App Store, payment is charged to your Apple ID account. Subscription management and cancellation is handled through your Apple ID account settings. Refund requests must be submitted to Apple in accordance with Apple's refund policies.
You may cancel your Subscription at any time. Cancellation takes effect at the end of the current billing period; you retain access until that date. No partial refunds are issued for unused time within a billing period, except where required by applicable law.
We reserve the right to change Subscription prices. You will be notified of any price change with at least 30 days' notice. Continued use of the Application after a price change constitutes acceptance of the new price.
You may not, and you agree not to or enable others to:
The Application and all copies thereof are proprietary to Bridge Comm. and title thereto remains in Bridge Comm. All rights in the Application not specifically granted in this Agreement are reserved to Bridge Comm. The Application is protected by copyright law and other intellectual property laws and treaties.
You acknowledge that no title to the intellectual property in the Application is transferred to you. You further acknowledge that title and full ownership rights to the Application will remain the exclusive property of Bridge Comm., and you will not acquire any rights to the Application except as expressly set forth in this Agreement.
Bridge Comm. is solely responsible for providing maintenance and support services with respect to the Application, as required under applicable law. You may contact us at support@macbookreader.it or via the support form at support page.
Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Application.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. BRIDGE COMM. EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
BRIDGE COMM. DOES NOT WARRANT THAT THE APPLICATION WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple (if you purchased through the Mac App Store) and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRIDGE COMM. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL) ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE APPLICATION, EVEN IF BRIDGE COMM. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BRIDGE COMM.'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE APPLICATION EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Nothing in this Agreement limits Bridge Comm.'s liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
Bridge Comm., not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, Bridge Comm., not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Your use of the Application is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. Bridge Comm. is committed to protecting your privacy. Your books, reading activity, highlights, and annotations remain on your device and are never transmitted to us. For full details, please read our Privacy Policy.
We may, from time to time, release updates to the Application. Updates may be delivered automatically or may require your action. By installing any update, you agree that this Agreement applies to any updated version of the Application. We reserve the right to modify, suspend, or discontinue the Application (or any feature thereof) at any time.
This Agreement is effective until terminated by you or Bridge Comm. Your rights under this Agreement will terminate automatically and without notice from Bridge Comm. if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Application and destroy all copies.
You may terminate this Agreement at any time by deleting the Application from all your devices and cancelling any active Subscription.
Sections 5, 7, 8, 9, 10, 15, and 16 of this Agreement shall survive any termination.
This Agreement shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. If you are a consumer resident in the European Union, you also benefit from the mandatory consumer protection provisions of the law of the country in which you are resident.
Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent courts of Rome, Italy, except where mandatory consumer protection laws of your country of residence confer jurisdiction on your local courts.
